Turuan mo ng basic law si Dick, Aguinaldo: Duterte orders Panelo to compel COA to audit Red Cross
President Rodrigo Duterte has ordered Presidential Legal Adviser Salvador Panelo to take charge in compelling Commission on Audit Chairman Michael G. Aguinaldo to review the books of the Philippine Red Cross.
“So ikaw na bahala diyan kay (Senator Dick) Gordon pati kay Aguinaldo ‘pag ayaw nilang sumunod,” said Duterte in a briefing.
Duterte is disappointed that Aguinaldo has taken the side of Gordon, the chairman of PRC since 2004, that PRC was not covered by COA being an “independent nongovernment organization.”
Duterte said the Constitution mandated COA to review and to audit even non-governmental organizations who receive regular subsidies from the government. PRC gets regular funds from Philhealth, Philippine Amusement and Gaming Corp., and Philippine Charity Sweepstakes Office (PCSO).
Panelo said the President was empowered to look into the financial condition and any irregularities in the PRC which was mandated to report an annual report on its accomplishments and finances.
Panelo suggested that the government file a petition for mandamus compelling COA to perform its duty to PRC. “Pag hindi ginawa ni Michael Aguinaldo, bilang head ng COA, ‘yung kanyang tungkulin, eh dereliction of duty ‘yun,” said Panelo.
“Masyado hong klaro, in fact, logic will dictate, napaka-basic naman ho ‘yun sa lahat ng mga law students, na ‘pag ang pera ng gobyerno ay natanggap ng anumang ahensya ng gobyerno o kahit na hindi ahensya ng gobyerno ay talagang may kapangyarihan po na pumasok ang gobyerno diyan at ang Commission on Audit. Kaya hindi po kailangan na pag-usapan ‘yun sapagkat masyado namang klaro ‘yun,” said Panelo.
