Tony La Viña points out Calida’s big mistake in support Bongbong’s poll protest case

Abogado Tony La Viña understands perfectly why the Supreme Court admonished Solicitor General Jose Calida for taking sides in the hotly-contested 2016 Vice Presidential race.

In a series of tweets, the law professor explained why the SC, sitting as the Presidential Electoral Tribunal, is considering to sue Calida for contempt of court as he supported and copied losing candidate Bongbong Marcos’ petition to kick Associate Justice Marvic Leonen out of the PET panel.

“The OSG motion supports the case of Marcos, a private citizen. They are not lawyering for the government as is their mandate nor for the people as Tribune. This is not right,” La Viña said.

For him, this makes Calida vulnerable to even more lawsuits.

“In fact, the filing of SolGen motion vs Leonen could violate Anti-Graft and Corrupt Practices Act (Republic Act 3019) which prohibit public officials from giving any private party any unwarranted benefits, advantage or preference in the discharge of their official functions,” the abogado added.
