Tama lang! Nograles agrees with SC decision to junk plea demanding Duterte to defend WPS from China
Malacañang believes the Supreme Court ruled correctly when it dismissed a petition for mandamus to compel President Rodrigo Duterte to take more aggressive action in defending the West Philippine Sea.
The high court junked the plea filed by lawyer Romeo Esmero, saying he was not able to establish which law or Constitutional provision that specifically requires the President to run to the United Nations and sue China for its incursions in the country’s exclusive economic zone.
“We welcome the decision of the Supreme Court dismissing the petition for mandamus filed against President Rodrigo Roa Duterte. Executive power, indeed, rests on the President, including the peaceful and stable conduct of foreign affairs,” acting spokesman and Cabinet Secretary Karlo Nograles said. “Matters within the President’s discretion cannot be compelled by mandamus.”
“President Duterte is the chief architect of foreign policy and this is affirmed by the latest decision of the High Court,” he added.
