SC should visit sub judice rule, says Te

As Solicitor General Jose Calida invoked the sub judice rule when he asked the Supreme Court to stop ABS-CBN from commenting on his quo warranto petition against the broadcast network, former SC spokesperson Theodore Te says it is not applicable to this case.

The subjudice rule, said the abogado “makes no sense” since the Philippines doesn’t have a jury system.

“It comes from common law where juries of ordinary people needed to be shielded from undue influence due to public comments on pending matters,” said Te.

“The SC should revisit the rule from the POV of free expression,” he added.
