Private or public: Gideo Peña clarifies laws on sharing screenshots, DMS

FEU Law Professor Gideon Peña clarified that there are two important distinctions on what one can share without consent. The abogado clarified that sharing another’s social media post without their consent is okay.

Peña said that this is allowed as seen in the case of Vivares v. STC. The abogado, however, explained that the same cannot be applied to messages or direct messages. He said that under the Data Privacy Act, it is punishable with jail time and a fine of 500,000 to 2 million.

The abogado added that if sensitive information is included, it can go up to 4 million. Peña said that there are some exemption such as when the screenshot shared does not have information that can identify the person.
