Larry Gadon opposes Milagros Cayosa’s application to CTA

Controversial lawyer Larry Gadon on Thursday asked the Judicial and Bar Council (JBC) to disqualify Ma. Milagros Fernan Cayosa in her bid for a vacant seat in the Court of Tax Appeals (CTA).

According to Gadon, Cayosa, a member of the JBC representing the Integrated Bar of the Philippines, was lacking in key qualifications for the CTA justice post, which are “proven competence, integrity, probity and independence.”

For one, Gadon bared that Cayosa lied in her testimony during the impeachment proceeding against ousted chief justice Ma. Lourdes Sereno when she claimed that the disgraced magistrate complied with the statement of assets, liabilities and net worth (SALN) requirement when she applied for the top judicial post in 2012.

“Atty. Cayosa was the one who lied and testified in the House of Representatives that Sereno complied with the SALN submission when Sereno applied for the chief justice position. It turned out that Sereno submitted only three out of the minimum requirement of 10 SALNs,” Gadon said.

“As a prime mover in the impeachment of Atty. Ma. Lourdes Sereno, I know for a fact that Cayosa committed irregularities at the JBC when she accepted the incomplete SALNs of Sereno during the latter’s application as chief justice then,” he added in his letter to the JBC.

“Aside from that unethical act, Cayosa has no experience being a judge of a lower court. She is neither an expert in taxation. Her only qualification as JBC member is being a representative of the IBP. There are other applicants more qualified and deserving,” Gadon continued.

Also, he pointed out that her Cayosa’s application for the CTA vacancies left by the retirement of Associate Justices Lovell Bautista and Caesar Casanova was a “conflict of interest, much more a sense of unprofessionalism” because of her membership in the JBC.

JBC is constitutionally mandated to screen and process applications in vacant positions in the judiciary.
