ICC Prosecutor Niang: Rody Duterte fit to stand trial

The prosecution in the crimes against humanity case against former President Rodrigo Duterte has asked the International Criminal Court (ICC) Trial Chamber III to declare him fit to stand trial as it cited the unanimous findings of a panel of medical experts.

In a submission signed by acting Prosecutor Mame Mandiaye Niang, the prosecution said the experts’ reports showed that Duterte is capable of meaningfully exercising his procedural and fair trial rights.

The panel of experts was appointed by the Trial Chamber after Duterte’s defense requested a medical examination before the start of trial.

According to the prosecution, the three experts personally interviewed and examined Duterte, reviewed relevant medical records and consulted his clinicians and custody staff.

The prosecution said the experts were impartial and independent and had sufficient information and time to complete their assessments.

Based on the panel’s unanimous findings, the prosecution asked the chamber to conclude that Duterte is “capable of meaningfully exercising his procedural and fair trial rights” and is fit for trial.

The prosecution also said a separate hearing on Duterte’s fitness is unnecessary by noting that the ICC rules do not require such a hearing.

It further asked the chamber to consider practical measures recommended by the experts to facilitate Duterte’s effective participation in trial proceedings.#
