Duterte gets schooled on immunity from suit
President Duterte got schooled over his recent statement that he will run for vice president to gain immunity from suit following threats of prosecution once he leaves Malacañang.
“That is rewriting the Constitution and even jurisprudence,” National Union of People’s Lawyers head Edre Olalia said over the weekend.
“Only the President is immune from suit and this is not even spelled out in the present Constitution.. ” he continued.
Philippine jurisprudence only confers immunity from suit to a sitting president.
Mr. Duterte said Saturday he will run for vice president in the 2022 elections.
“Sabi ng batas, na kung presidente ka, bise presidente ka, may immunity ka. Eh di tatakbo na lang akong bise presidente,” Duterte said during the national assembly of Partido Demokratiko Pilipino – Lakas ng Bayan.
Duterte continued, “And after that, tatakbo ulit ako nang bise presidente at bise presidente at bise presidente.”
