CTA sentences a Davao-based importer to 12 years in prison
The Court of Tax Appeals (CTA) upheld its ruling convicting a Davao-based importer of smuggling.
Moises Bagan Rodriguez, owner of Yanzhen Enterprises of Digoz City, Davao del Sur, was sentenced to a prison of term of 12 years.
The CTA en banc found that the Third Division did not erred when it handed down the original decision.
Also, the CTA citing Section 1203 of the Tariff and Customs Code of the Philippine said: “All articles imported into the Philippines shall be held to be the property of the person to whom the same is consigned,” as receipts showed “Yanzhe” as owner of the shipment.
Records showed the company imported shipment of onions disguised as “pastry ingredients and dough” to avail of the lower tariff rate of 15 percent, instead of the 40 percent.
Because of this, the company evaded payment of some P1.4 million in taxes.
