CTA aspirant Fernan-Cayosa told to reply to Gadon’s conflict of interest issue raised against her

The Judicial and Bar Council (JBC) has asked an applicant for a vacancy in the Court of Tax Appeals (CTA) to comment on an opposition to her appointment filed last month by senatorial candidate and lawyer, Lorenzo “Larry” Gadon.

In a letter dated March 29, JBC executive officer Annaliza S. Ty-Capacite asked lawyer Maria Milagros Fernan-Cayosa to file a comment within five days.

Last March, Gadon formally filed before the JBC his opposition to the application of Fernan-Cayosa to the position of Associate Justice of the CTA.

In letters addressed to Chief Justice and JBC ex-officio chairman Lucas Bersamin, Gadon cited Fenan-Cayosa’s “conflict of interest” and “unprofessionalism” when she sent an application letter to the JBC, of which she is a regular member, and of which the same body would deliberate on the very same application.

“Fernan-Cayosa should have resigned from the JBC prior to her applying for the position of CTA justice,” Gadon said.

“I know for a fact that Fernan-Cayosa committed irregularities at the JBC when she accepted the incomplete statement of assets, liabilities and net worth (SALN) of Sereno during the latter’s application as Chief Justice then,” Gadon said in his opposition.

The JBC is the constitutional body that screens and recommends to the President appointments to the judiciary. (PNA)
