Court junks de Lima’s MR over ruling denying her demurrer

The Muntinlupa City regional trial court on Friday denied the motion for reconsideration filed by opposition leader and now detained Sen. Leila de Lima who sought to overturn the court’s February 17, 2021 omnibus order that denied her demurrer to evidence and petition for bail in connection with her illegal drugs case.

In an order, Branch 205 Judge Liezel Aquiatan denied de Lima’s motion, including the similar motion filed by personal driver Ronnie Dayan, for lack of merit.

“The court stands with its Omnibus Order that accused de Lima and Dayan must present evidence to prove their innocence of the crime charged,” the order read in part.

In Criminal Case No. 17-165 where Dayan was her co-accused, Aquiatan has denied de Lima’s demurrer to evidence and petition for bail.

Also, Aquiatan set the reception of defense evidence on March 5, 2021 at 9am.

De Lima and Dayan were accused of conspiring and confederating with each other to commit illegal drugs trading.

The Department of Justice charged them for conspiracy to commit illegal drug trading, violation of Section 26 (b) in relation to Section 5, Section 3 (jj), and Section 28 of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002.

De Lima is currently detained at the Custodial Center of the Philippine National Police in Camp Crame.

The embattled lawmaker is facing separate drugs charges before the Muntinlupa RTC. A separate case for disobedience to summons is now pending before a Quezon City court.

Meanwhile, the same court in a separate order, Aquiatan also denied the motion for reconsideration filed by Jose Adrian Dera aka “Jad de Vera and Jed.”

Dera sought reconsideration on the court’s order junking his demurrer to evidence. (AFP)
