The Manila regional trial court branch 20 on Tuesday denied the petition for the issuance of a writ of habeas corpus filed by the wife of Dr. Bryan Sy – the owner WellMed Dialysis and Laboratory Center in Quezon City, which was implicated in the fictitious dialysis claims paid by Philippine Health Insurance Corp. (PhilHealth).

In a three-page order, Presiding Judge Marivic Balisi-Umali stressed that “the absence of probable cause for the warrantless arrest had been held not a valid ground for the issuance of a writ of habeas corpus.”

Therese Francesca Tan-Sy challenged the legality her husband’s arrest and sought a writ of habeas corpus.

This prompted the National Bureau of Investigation to present Dr. Sy before the Manila RTC at around 3 p.m. on Tuesday in response to Tan-Sy’s petition.
