Cherry picking daw! De Lima accuses judge of mishandling drug case
Senator Leila De Lima accused the Regional Trial Court judge handling one of her two remaining drug cases of improperly appreciating evidence –– or the lack thereof.
De Lima’s lawyers filed a motion for reconsideration to the demurrer to evidence rejected by Muntinlupa RTC branch 205 presiding judge Liezel Aquiatan last week, saying she appears to have a “sampling bias, cherry picking, suppressing evidence, and a fallacy of incomplete evidence” in handling her case.
The abogados from the Rigoroso Galindez and Rabino Law Offices argued that the judge has not properly taken stock of their demurrer to evidence, which if granted will mean submission of the case for decision. She also committed “patent but reversible errors” and failed to address points raised by De Lima’s camp in previous requests for bail.
They also faulted the judge for heavily quoting the prosecution in past decisions and barely citing De Lima’s side in decisions.
The detained senator wants the charges against her and Ronnie Dayan dismissed already.
