CA clears comedian Jose Manalo from estranged wife’s huge debt
Popular television host and comedian Jose Manalo has been cleared by the Court of Appeals from civil liability in the multimillion-peso case involving his estranged wife Annalyn.
This as the CA in resolution junked with finality a suit that sought to implead Manalo in the P50-million deal between Annalyn and businessman Froilan Clemente Jr. over settlement of an unpaid debt.
The CA stood pat with its earlier ruling that Manalo was a non-party to the settlement deal between his estranged wife and Clemente.
“To repeat, the compromise agreement was signed by only one of the two defendants: Annalyn. On the other hand, herein private respondent Ariel or Jose, her husband and co-defendant, was not made a party to the settlement with the plaintiff, Froilan,” read the ruling.
Also, the CA stressed the compromise deal was void in so far as Manalo was concerned because he was named as a party even without his consent.
“More importantly, the main provisions of said compromise agreement involve admissions of liabilities and assumption of obligations made by Annalyn, not only for herself, but also on behalf of her husband Ariel, even if the latter was not made a party to the settlement. This is contrary to law because the element of consent, on the part of private respondent, is lacking,” the CA stressed.
