Trillanes camp mulls to file motion to dismiss libel suit
The camp of embattled opposition Sen. Antonio Trillanes IV is seriously considering of questioning the jurisdiction of the Davao City Prosecutor’s Office over the libel charges filed against the lawmaker by former Davao City vice mayor Paolo Duterte and lawyer Manases Carpio.
Lawyer Rey Robles, counsel of Trillanes, explained the libel case should have been filed in Cebu since the supposed offense was said to be committed there, not in Davao.
“Well, ang question ho namin dyan bakit ho sa Davao City nakafile yung kaso? All of the allegations of the complaint we just received, ang elements nangyari sa Cebu, pati mga testigo sa Cebu. Sa tingin ho namin walang jurisdiction ang piskalya ng Davao and we will file appropriate motions at the appropriate time,” Robles said.
The lawyer said that Trillanes camp may move for the dismissal of the case due to lack of jurisdiction.
In separate complaints, Duterte and Carpio claimed Trillanes maligned them for accusing them of extortion involving UBER and other companies regulated by the Land Transportation Franchising and Regulation Board, and the Department of Public Works and Highways during a radio interview over dyAB Cebu last year.
Duterte said Trillanes’ remarks were intended to “malign, destroy and kill my good name and reputation locally, nationally, and internationally.”
