SC sacks Compostela clerk of court over P1.9M cash shortage
The Supreme Court (SC) has dismissed a Compostela Valley clerk of court from service in connection with a shortage of P1.9 million in court funds.
In a recent 8-page en banc decision, the SC found Monkayo-Montevista Municipal Circuit Trial Court (MCTC) clerk of court Ruby Dalawis guilty of gross neglect of duty and grave misconduct.
She was also ordered to return the shortfall to the SC, which include the P1.57 million fiduciary fund, the P70,008.40 judiciary development fund, the P204,039.60 special allowance for the judiciary fund, the P39,500 mediation fund, and the P6,000 general funds.
The SC also directed the Office of Court Administrator (OCA) to file the appropriate criminal charges against Dalawis.
Dalawis was faulted to failing to remit or deposit her judiciary collections for the period of April to December 2015.
The SC also cited her unauthorized withdrawals from the court’s fiduciary fund savings, as well as her alleged misappropriation of the funds for her personal use.
The loss of the amount was an “evident manifestation of her inability to efficiently and conscientiously discharge her duties as the administrative officer of the court,” read the per curiam decision.
