Estelito magic! Sandiganbayan junks plunder case against Erap dummy Jaime Dichaves
Hotshot defense lawyer Estelito Mendoza has scored again.
This time, it was businessman Jaime Dichaves, the alleged dummy of former President Joseph Estrada, who was cleared of plunder charges.
In a recent 14-page minute resolution, the Sandiganbayan 4th Division cited the “failure of the prosecution to present additional evidence to support the existence of probable cause” against Dichaves, who claimed to be the owner of Estrada’s “Jose Velarde” bank account.
The prosecution merely submitted a list of documentary and testimonial evidence presented against Estrada during the trial that led to his conviction for plunder.
But, the court said it could not “take judicial notice” of its pronouncements in its 2007 verdict, because it would violate Dichaves’s right to confront the witnesses.
The minute resolution was signed by Associate Justice Alex Quiroz, Reynaldo Cruz and Bayani Jacinto.
