CA halts MRTDC’s advertising rights over MRT3
The MRT Development Corporation (MRTDC) was stopped from exercising its advertising and commercial leasing rights over the MRT 3 system.
This was after the Court of Appeals (CA) upheld its previous ruling by denying the MRTDC’s motion for reconsideration for lack of new arguments to warrant the reversal of the ruling.
The MR’s denial prevented the MRTDC’s leasing rights over the MRT 3 system
pending the result of arbitration proceedings involving its development rights payment (DRP) of P2.3 billion with the government.
“The respondent’s claims have been
judiciously passed upon in our decision, and we find no compelling reason to undertake a second review of the same issues,” the CA ruled.
In its motion, the MRTDC sought the immediate issuance of a writ of preliminary injunction allowing its continued operation pending the result of the arbitration.
Also, it insisted that it had not violated the Build, Lease and Transfer Agreement it had entered into with the government and that its DRP were updated.
